RESOLUTION 2007-2

A RESOLUTION OF THE BAREFOOT BAY RECREATION DISTRICT ACKNOWLEDGING AND CREATING A BAREFOOT BAY Y0UTH GROUP, PROVIDING FOR A LOCATION FOR MEETINGS AND YOUTH ACTIVITIES, PROVIDING THAT THE YOUTH GROUP SHALL BE A PROGRAM SPONSORED BY AND ENDORSED BY THE BAREFOOT BAY RECREATION DISTRICT AND COVERED BY THE BAREFOOT BAY RECREATION DISTRICT’S INSURANCE POLICY, CREATING A SPECIAL FUND FOR RECEIPT AND MONITORING OF DONATIONS FOR USE BY THE BAREFOOT BAY YOUTH GROUP AND PROVIDING FOR REQUIREMENT FOR BACKGROUND CHECKS FOR ANY ADULTS ENGAGING IN SUPERVISION OF THE BAREFOOT BAY YOUTH GROUP PROGRAM.

WHEREAS, the Barefoot Bay Recreation District has experienced a growth in its youth population in recent years; and

            WHEREAS, the Barefoot Bay Board of Trustees desires to create a youth program to provide activities for the youth of the Barefoot Bay Recreation District; and

WHEREAS, the Barefoot Bay Board of Trustees desires to provide a location for these youth activities as well as include activities of the youth organization within the existing insurance coverage of Barefoot Bay; and

WHEREAS, the Barefoot Bay Board of Trustees wishes to provide for a method for individuals to donate funds to a monitored fund for youth by the Barefoot Bay Youth Program; and

WHEREAS, the Barefoot Bay Recreation District wishes to ensure the safety of its youth by requiring all adults involved in supervision of the youth activities to submit to an appropriate background investigation.

NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF TRUSTEES OFTHE BAREFOOT BAY RECREATION DISTRICT AS FOLLOWS:

1.         The Barefoot Bay Board of Trustees hereby establishes the Barefoot Bay Youth Group.  The Board of Trustees acknowledges and agrees to provide an appropriate facility for youth by the Barefoot Bay Youth Group when conducting its activities.

2.         The Board of Trustees further resolve to contact the Florida League of Cities or other appropriate insurance carrier already providing insurance to the Barefoot Bay Recreation District for liability purposes, to ensure that the Barefoot Bay Youth Group activities are covered by the Barefoot Bay Recreation Districts’ existing insurance.

3.         Further, the Board of Trustees hereby instruct the management of Barefoot Bay to create a line item account within the Barefoot Bay accounting system for the sole purpose of receiving and distributing donations to the Barefoot Bay Youth Group, said funds to be monitored as required by all applicable government standards of accounting.

4.         Further, the Board of Trustees hereby directs the management of Barefoot Bay to require that any and all volunteers who are assisting in the supervision of youth activities for the Barefoot Bay Youth Group submit to an FDLE background check or background check through any other agency as approved by management of Barefoot Bay.  The Board of Trustees does not ensure the validity of any such background check, only that such check be performed, and expressly disclaims any and all liability regarding the validity thereof.

5.         This resolution shall take effect immediately upon its enactment.

            The foregoing resolution was moved for adoption by Trustee ________________.  The motion was seconded by Trustee __________________ and, upon being put to a vote, that vote was as follows:
