RESOLUTION 2003-01

A RESOLUTION OF THE BOARD OF TRUSTEES OF THE BAREFOOT BAY RECREATION DISTRICT REVISING RESOLUTION 2001-09, ARTICLE I, SECTION 4, GENERAL RULE, PARAGRAPH 19, AND ARTICLE V, DISTRICT FACILITIES, SECTION 10, FEE SCHEDULE, SOFTBALL RULES AND REGULATIONS, PARAGRAPH 3 AND PARAGRAPH 9; AND PROVIDING FOR AN EFFECTIVE DATE.

WHEREAS, the Board of Trustees had adopted Resolution 2001-09 establishing a set of Rules, Regulations, and Fees for the residents of Barefoot Bay in relation to the operation of the Recreational Facilities of Barefoot Bay, and

WHEREAS, the Board of Trustees of Barefoot Bay Recreation District is desirous of revising the Rules, Regulations, and Fees regarding the application of the $2.00 user fee by a nonresident when the nonresident is using the District’s facilities in the context of a club activity or social function; and,

WHEREAS, the Board of Trustees of Barefoot Bay Recreation District is desirous of deleting Article I, Section 4, General Rule, Paragraph 19, and Article V, District Facilities, Section 10, Fee Schedule, Softball Rules And Regulations, Paragraph 3 and Paragraph 9; and

WHEREAS, the Board of Trustees of Barefoot Bay Recreation District is desirous of add the following language to Article I, Section 4, General Rule, Paragraph 19:  A $2.00 per person guest fee shall be charged to any nonresident for use of District facilities.  This fee shall not be charged to a nonresident using District facilities as an invitee for a club activity or social function conducted by an organization authorized, by the District, to conduct activities on District facilities; and

WHEREAS, the Board of Trustees of Barefoot Bay Recreation District held a Public Hearing seeking public input on this amendment at a public workshop held on February 25, 2003.

NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE BAREFOOT BAY RECREATION DISTRICT, BREVARD COUNTY, FLORIDA

Section 1.  Article I, Section 4, General Rule, Paragraph 19 – Deleted in its entirety

Article V, District Facilities, Section 10, Fee Schedule, Softball Rules And Regulations, Paragraph 3 – Deleted in its entirety

Article V, District Facilities, Section 10, Fee Schedule, Softball Rules And Regulations, Paragraph 9 – Deleted in its entirety

Section 2.  Add the following language to Article I, Section 4, General Rule, Paragraph 19:  A $2.00 per person guest fee shall be charged to any nonresident for use of District facilities.  This fee shall not be charged to a nonresident using District facilities as an invitee for a club activity or social function conducted by an organization authorized, by the District, to conduct activities on District facilities.

Section 3.  Effective Date.  This Resolution shall become effective March 14, 2003.
