A RESOLUTION OF THE BOARD OF TRUSTEES OF THE BAREFOOT BAY RECREATION DISTRICT , BREVARD COUNTY, FLORIDA, PERTAINING TO THE USE OF THE GREAT SEAL OF THE STATE OF FLORIDA; PROVIDING FOR THE CHAIRMAN TO AUTHORIZE THE USE OF THE GREAT SEAL OF THE STATE OF FLORIDA; PROVIDING FOR THE REBROADCAST OF THE GREAT SEAL OF THE STATE OF FLORIDA; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICT WITH OTHER PROVISIONS AND; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, The Barefoot Bay Board of Trustees uses as its Seal the Great Seal of the State of Florida (hereinafter "Seal"); and
WHEREAS, The Barefoot Bay Recreation District broadcasts District meetings to the general public on the Brevard County Government Channel; and
WHEREAS, The Brevard County Department of Broadcasting has requested the Barefoot Bay Recreational District to provide proof of authority for use of the Seal during broadcast meetings;
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE BAREFOOT BAY RECREATION DISTRICT, BREVARD COUNTY, FLORIDA, as follows:
Section 1. Use of the State Seal as the Seal of the Barefoot Bay Recreation District.
Pursuant to Florida Administrative Code, the District hereby designates authority to Bruce Bolon, Chairman, to authorize the use of the State Seal for official purposes.
Section 2. Rebroadcast.
Bruce Bolon, in his official capacity as Chairman of the Barefoot Bay Recreation District, is hereby authorized the use of the Seal for the purposes of rebroadcast on the Brevard County Government Channel.
Section 3. Severability.
If any portion, clause, phrase, sentence or classification of this resolution is held or declared to be either unconstitutional, invalid, inapplicable, inoperative or void, then such declaration shall not be construed to affect other portions of the resolution; it is hereby declared to be the expressed opinion of the Trustees of the Barefoot Bay Recreation District that any such unconstitutional, invalid, inapplicable, inoperative or void portion or portions of this resolution did not induce its passage, and that without the inclusion of any such portion or portions of this resolution, the Trustees would have enacted the valid constitutional portions thereof.
Section 4. Conflict with other Provisions.
All resolutions or parts of resolutions in conflict herewith are hereby repealed and all resolutions or parts or resolutions not in conflict herewith are hereby continued in full force and effect.
Section 5. Effective Date.
This Resolution shall become effective immediately upon its adoption.
PASSED AND ADOPTED AT A MEETING OF THE BOARD OF TRUSTEES OF THE BAREFOOT BAY RECREATION DISTRICT HELD THIS 12th DAY OF APRIL, 2002.
