RESOLUTION 2001-12

A RESOLUTION OF THE BOARD OF TRUSTEES OF THE BAREFOOT BAY RECREATION DISTRICT REVISING RESOLUTION 2001-09, ARTICLE II, SECTION 2.3.(C), CHANGES IN GOLF MEMBERSHIP; AND ARTICLE III, SECTION 2 (4) GOLF MEMBERSHIP DUES; AND PROVIDING FOR AN EFFECTIVE DATE.

WHEREAS, The Board of Trustees had adopted Resolution 2001-09 establishing a set of Rules, Regulations, and fees for the residents of Barefoot Bay in relation to the operation of the Recreational Facilities of Barefoot Bay, and

WHEREAS, The Board of Trustees of Barefoot Bay is desirous of amending Article II, Section 2, 3.(C); and Article III, Section 2 (4); and;

WHEREAS, the Board of Trustees of Barefoot Bay held a Public Hearing seeking public input on these amendments at a public meeting held on December 14, 2001.

NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE BAREFOOT BAY RECREATION DISTRICT, BREVARD COUNTY , FLORIDA

Section 1. Article II, Section 2.3 (C)

A member may terminate his or her golf membership, or Trail fees only for medical reasons, or death. Documentation from his or her doctor either limiting or prohibiting the members ability to play shall be required. This request must be in writing to the Pro Shop Manager, and must be approved by the Community Manager prior to any return of any funds for unused fees. Both membership and trail fees will be returned on a pro-rata basis for the first 6 months of the calendar year. After July 1 of any calendar year there will be no return of any unused portion of fees.

Section 2. Article III, Section 2 (4)

Membership dues or the first of three (3) installments are due on or before January 1 of each calendar year. (Second and third payments are due February 1st. and March 1st). Statements will be issued thirty (30) days in advance of the due date. If the installment method of payment is utilized, there will be a $3.00 handling charge per payment for each additional payment.

Section 3. The revised regulations and fee schedule shall take effect the first day of the month following the adoption of this resolution by the Board of Trustees.
