RESOLUTION 2001-10

 

A RESOLUTION OF THE TRUSTEES OF THE BAREFOOT BAY RECREATION DISTRICT CALLING FOR A REFERENDUM ELECTION TO AUTHORIZE THE BOARD OF TRUSTEES TO CONSTRUCT ADDITIONAL REST ROOM FACILITIES IN EXCESS OF $25,000.

 

WHEREAS, Brevard County Ordinance 84-05, and Florida Statute 418.304(13) mandate that the Barefoot Bay Recreation District must have voter approval in order to obligate itself for new acquisitions in excess of $25,000.00 in total costs, and

 

WHEREAS, It is the opinion of the Board of Trustees of the Barefoot Bay Recreation District that the following project should be submitted to the electorate of Barefoot Bay, and

 

NOW THEREFORE BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE BAREFOOT BAY RECREATION DISTRICT, BREVARD COUNTY, FLORIDA, that

Section 1. The Board of Trustees of the Barefoot Bay Recreation District hereby call for a referendum to be held on November 6, 2001 for the purpose of submitting to the qualified voters of the Barefoot Bay Recreation District the following question:

Referendum #2 AUTHORIZATION FOR THE BOARD OF TRUSTEES TO CONSTRUCT ADDITIONAL REST ROOM FACILITIES IN BUILDING "A"

Shall the Board of Trustees of the Barefoot Bay Recreation District be authorized to construct additional rest room facilities to service Building "A" in excess of the $25,000 acquisition limitation?

YES ____________ NO _____________

Section 2. The Community Manager of the Barefoot Bay Recreation District is directed to publish notice of this referendum in a newspaper of local circulation within the Barefoot Bay Recreation District.

 

Section 3. The referendum described herein shall be held in accordance with this Ordinance and the laws of the State of Florida.

 

Section 4. Following the referendum described herein, the Board of Trustees of the Barefoot Bay Recreation District shall adopt a resolution declaring and ratifying the results of the referendum.

 

Section 5. Should any section or provision of this resolution be declared by a Court of Competent Jurisdiction be declared to be invalid or unconstitutional, such decision should not affect the validity of the remainder of this resolution, and the remainder shall continue in full force and effect.

 

Section 6. This Resolution shall take affect immediately upon its adoption.

 

Section 7. This Resolution was duly passed at a regular meeting of the Barefoot Bay Recreation district on September 17, 2001.
