RESOLUTION 2001-01
A RESOLUTION OF THE BAREFOOT BAY RECREATIONAL DISTRICT, BREVARD COUNTY, FLORIDA PERTAINING TO PARKING SPACES FOR PERSONS WHO HAVE DISABILITIES; PROVIDING FOR PARKING SPACES SPECIFICALLY DESIGNATED FOR THOSE PERSONS WHO ARE CONFINED TO WHEEL CHAIRS; PROVIDING FOR PENALTY; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICT; PROVIDING INCLUSION IN CODE OF RESOLUTION; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Barefoot Bay Recreational District has a higher than average need for parking spaces for persons who have disabilities; and
WHEREAS, the Barefoot Bay Recreational District has provided more than the required allotment of parking spaces for persons who have disabilities pursuant to Florida Statute; and
WHEREAS, the Barefoot Bay Recreational District has determined that there is a specific need to designate certain parking spaces for those persons who are confined to wheel chairs; and
WHEREAS, the Barefoot Bay Recreational District desires to create parking spaces that are designated solely for use by dependent persons.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE BAREFOOT BAY RECREATIONAL DISTRICT, BREVARD COUNTY, FLORIDA, as follows:
Section 1. Parking Spaces for Persons Who Have Disabilities
AA@ (attached) for the exclusive use of those individuals who are confined to a wheel chair. Said parking spaces shall be duly posted pursuant to Florida Statutes and shall contain language indicating that these spaces are designated for wheel chair accessible parking only.Pursuant to Florida Statute, the Barefoot Bay Recreational District hereby designates those parking spaces as designated in Exhibit
Section 2. Violations
(A) Any individual parking in a wheel chair designated parking space, who is not confined to a wheel chair and does not otherwise possess a valid handicapped parking permit, will be punished pursuant to Florida Statute 316.1957 and other applicable of Florida law.
Atow away zones@ and any vehicles parked in said spaces, without proper permit for use as a wheel chair accessible only, shall be towed at the discretion of the Barefoot Bay Recreational District. Expenses for said towing shall be borne by the owner of said vehicle.(B) Additionally, the Barefoot Bay Recreational District shall deem said wheel chair accessible parking spaces as
Towing of said vehicle shall be in addition to any other applicable state or local fines as deemed appropriate.
Section 3. Severability.
If any portion, clause, phrase, sentence or classification of this resolution is held or declared to be either unconstitutional, invalid, inapplicable, inoperative or void, then such declaration shall not be construed to affect other portions of the resolution; it is hereby declared to be the express opinion of the Trustees of the Barefoot Bay Recreation District that any such unconstitutional, invalid, inapplicable, inoperative or void portion or portions of this resolution did not induce its passage, and that without the inclusion of any such portion or portions of this resolution, the Trustees would have enacted the valid constitutional portions thereof.
Section 4. Conflict with other Provisions.
All resolutions or parts of resolutions in conflict herewith are hereby repealed and all resolutions or parts or resolutions not in conflict herewith are hereby continued in full force and effect.
Section 5. Part of the Code of Resolutions.
It is the intention of the Trustees of the Barefoot Bay Recreation District that the provisions of this resolution shall be made a part of the Barefoot Bay Code of Resolutions and the sections may be renumbered to accomplish such intentions.
Section 6. Effective Date
This resolution shall become effective immediately upon its adoption by the Barefoot Bay Board of Trustees.
